Terms of Use

Version 2026-11-02

YachtPlan is run by Stefania Malpeli, Marina di Pertusola, Lerici (SP), Italy (“we”). These terms are a condition of using YachtPlan. You accept them by ticking the box the first time you sign in, and again after any update. If you do not accept, do not use YachtPlan.

1. Who can use it

You must be 18 or older. By ticking the box when you first sign in you confirm that you are.

Why 18? These terms are a contract. They set limits on what we are responsible for and make you responsible for your documents, for checking the maintenance information against your manuals, and for your boat. In Italy and in most other EU countries a person under 18 generally cannot make a binding contract on their own, and people who own and maintain a boat are in practice adults. If you are younger and sail, ask a parent or the boat’s owner to use YachtPlan. We cannot check your age, so we rely on your word, and we delete accounts we learn belong to someone younger.

2. Your account

You sign in with Google or an emailed link. Keep access to that account and email address safe: you are responsible for what happens under your account. You can download your data and delete your account at any time in the app (account area); deletion is immediate and permanent.

3. Your documents and content — you are responsible

You keep ownership of everything you add: boats, checklists, notes and uploaded documents. You give us permission to store and process it only as needed to run YachtPlan for you, including sending it to the AI provider you chose when you switch AI on (section 4).

You are responsible for checking that you may upload, copy, scan and have an AI read each document you add. Manuals, certificates and drawings are usually protected by copyright or by the maker’s own terms, and some forbid copying or processing. We do not review, check or approve what you upload, and we have no duty to. Do not upload anything you have no right to upload, anything unlawful, or other people’s personal data. If we are told a document should not be here, we may remove it without notice.

Checklist templates and .ypl files you export and share contain checklist text, not your document files. You are responsible for what you share and for having the right to share it. Do not put copyrighted manual text into templates. Names of boat and equipment makers are used only to say what a checklist is for; YachtPlan is not affiliated with, and a template is not approved by, any maker.

4. AI is optional, and can be wrong

AI features run only if you switch them on, using your own account and API key with a provider you choose. Your provider’s terms, prices and privacy rules apply to that use, and any cost is yours. AI reads documents and writes or changes checklist items, titles, summaries and translations. It makes mistakes. Check anything it produces against the original manual before you rely on it. With AI switched off, YachtPlan makes no AI calls for you.

5. Not advice — you remain responsible for the boat

Intervals, tasks and templates are general guidance. Some are averages, some came from a manual, some were written by you or by AI, and some may be wrong, incomplete or out of date for your boat. They do not replace the manufacturer’s manual, a qualified marine engineer or surveyor, or the rules of your flag state, class society or insurer. The “safety critical” flag and the inspection-readiness log are aids, not certification, a survey or a guarantee. You alone are responsible for your vessel, the people aboard and decisions about maintenance and use.

6. No warranties and no obligations

YachtPlan is provided “as is” and “as available”, without warranty of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, availability, security and non-infringement. We have no obligation to provide, maintain, update, support, correct or keep available the service or any feature, to back up or restore your data, to keep your account, or to notify you of anything, including a due date. We may change, suspend or end the service, or any account, at any time. Keep your own copies: use the data download.

7. Liability

To the fullest extent the law allows, we are not liable for any loss or damage arising from using or not being able to use YachtPlan, including damage to a vessel, injury, missed or wrong maintenance, lost data, lost income or any indirect loss. Nothing here limits liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud — or any right you have as a consumer that cannot be waived.

8. Free, and donations are voluntary

YachtPlan is free. If you find it useful you may make a voluntary donation through the link we provide. A donation is a gift: it buys nothing, gives no extra features, support, priority or rights, is not refundable, and changes nothing in these terms. The donation is handled on the payment provider’s own page, under its own terms and privacy policy. If we ever add paid features, they will have their own terms and you will see the price before you pay.

9. Changes

We may update these terms. The version date is at the top. If you keep using YachtPlan after a change, you accept it.

10. Privacy

11. Law

These terms are governed by Italian law. If you are a consumer you keep the mandatory protections of the country where you live and may bring a claim in the courts of your place of residence.
